Editorial context

Tamil Nadu Chief Minister M.K. Stalin warmly welcomed the historic judgment of the Supreme Court ordering the premature release of Nalini, Ravichandran, and four other life convicts who had spent over three decades in prison. Characterizing the verdict as a monumental victory for human rights, persistent legal struggles, and constitutional democracy, Stalin noted that the ruling reaffirmed the cardinal democratic principle that nominated gubernatorial authorities cannot indefinitely sit upon or stall decisions enacted by an elected state cabinet.

Recalling the earlier release of A.G. Perarivalan under Article 142, the Chief Minister pointed out that the DMK government had consistently advocated the release of all seven convicts on humanitarian grounds, passing unanimous cabinet resolutions and adopting assembly resolutions urging executive clemency. The prolonged gubernatorial delay in deciding their mercy petitions had created an unconstitutional deadlock, which the apex court decisively resolved by upholding the binding nature of aid and advice tendered by the Council of Ministers.

Stalin concluded that the verdict establishes an invaluable constitutional precedent protecting elected state cabinets from arbitrary executive obstruction. By championing justice and human dignity, Tamil Nadu continues to strengthen constitutional morality and democratic federalism throughout the republic.
