It is an established norm that the secretary of assembly should inform the media & sitting MLAs regarding a constituency falling vacant.
Reminding the Tamil Nadu legislative administration of longstanding parliamentary protocol, DMK Treasurer and Kolathur legislator M. K. Stalin highlighted that the secretary of the legislative assembly must officially communicate constituency vacancies to sitting legislators and news media without political bias. Stalin underscored that notifying an electoral vacancy is an established constitutional convention designed to preserve legislative transparency and enable the Election Commission of India to schedule timely by-elections. He observed that following high-profile disqualifications, administrative silence and deliberate procedural delays by the assembly secretariat undermine public trust in parliamentary institutions and deprive electors of their rightful representation. By failing to issue prompt formal notifications, the administrative apparatus appeared subservient to partisan interests rather than constitutional mandates. Stalin emphasized that every citizen has an unassailable democratic right to representation in the house, asserting that institutional secretaries cannot withhold official declarations regarding vacant legislative seats. He demanded that the assembly administration uphold statutory obligations impartially, promptly issue clear notifications regarding vacant constituencies immediately, and ensure that democratic governance operates strictly according to constitutional norms rather than ruling party convenience across Tamil Nadu.
